בקשת גרין קארד

הגעתי לארה"ב לפני מספר חודשים על ויזת L1, ורציתי לשאול מספר שאלות לגבי בקשה למעבר לסטטוס תושב קבע (Greed Card). א. אם אגיש את הבקשה כעת, תוך כמה זמן באופן טיפוסי תאושר הבקשה? ב. האם ככל שאגיש את הבקשה מוקדם יותר היא תאושר מוקדם יותר? כלומר - היה ולמשל אגיש את הבקשה עוד שנתיים, מתי עלי לצפות לאישור? ג. האם כדאי לי להגיש את הבקשה מוקדם ככל האפשר (כלומר עכשיו)? האם יהיה לי איזשהו יתרון הנובע מהגשה מוקדמת? אני מבין שהרשויות כאן לא בדיוק מקלות, ואין להן לו"ז מדוייק למתן האישורים - אני מבקש ממי שיש לו ניסיון רב משלי "מספר אצבע" לגבי אורך הזמן שהדברים יקחו. תודה רבה, טל.

L1 and green card issues

To qualify for a green card as an L1A holder you must have been employed as a manager or executive outside the United States for the same U.S. employer, subsidiary or affiliate of the U.S. employer for at least one year within the last three. You must also be entering the United States to work as a manager or executive of the U.S. employer. On July 31, 2002 a new law was passed that makes the green card process for certain applications much quicker. Previously, the I-140(the application that is used to qualify L1's for green cards) had to have first been approved before an adjustment of status application could be submitted. By consolidating the process, employment-based green card applicants will be able to process green card applications much more quickly and will also have an easier time maintaining their status when they run out of time on non-immigrant visas. It also is good news for spouses and children of I-140 applicants who can now get work documents much more quickly. Concurrent filing means that an individual can file an I-140 petition to be classified in an employment-based green card category at the same time as an adjustment of status petition which generally focuses on whether an applicant is admissible to the US (e.g. there is a criminal history, communicable disease, etc.). The applicant must still prepare the two petitions in the same way as before, but they can now be submitted together. The process can last 12 months or more depending on the backlog of cases.
