Hi Galit, Since the H-1B visa is considered a temporary visa, there is a limitation on periods of stay. The initial periods of stay may be approved for up to 3 years (usually depending on the occupation and/or the needs of the employer). And after that, another 3 years are available, by filing forms for and extension of stay. After the six years, the worker must spend one year outside the U.S. before being entitled to another H-1B visa. However, many workers take steps to obtain permanent residence (the Green Card) during their initial 6-year stay. According to a new law that was passed a few years ago, now there is a way to extend the 6 year year limit under certain conditions. The H-1B visa six year time limit is not applicable to people with I-140 employment-based immigration applications or adjustment of status applications if a year or more has passed since the labor certification was filed or the I-140 was filed. H-1B visas may be extended pursuant to this section in one year increments until the final decision comes in on the green card application. So you might be able to do so if your company start the green card process for you. It is hard to summerize the employment green card process in a few lines but i will try. There are two main phases to the employment-based process. Phase I: The alien must be sponsored by the employer, who files documentation with the DOL to certify that there is, indeed, a shortage of U.S. workers for that particular position (called Alien Employment Labor Certification). Once certified by the DOL, the employer then files a petition with INS to have the alien classified as a person qualified to immigrate. (For Physical Therapists and Registered Nurses, it's faster). Phase II: Once the alien is found qualified to immigrate, he or she may proceed to apply for permanent resident status. This can been done through Consular Processing or by Adjustment of Status. Once the immigrant visa is issued, the permanent resident may then travel freely on the visa, and may accept employment without restrictions. The process may take up to 2 years to complete.
