שלום אני גרה בניו יורק כבר מעל 5 שנים, ליפני כשנה וחצי התחתנתי עם בן זוגי שיש לו גרין כארד. את הגרין כארד הוא קיבל ליפני כ-5 שנים ועכשיו הוא התחיל בתהליך לקבלת אזרחות. לפי מה שבררנו יש האומרים כי אני אוכל לקבל אזרחות או גרין כארד רק כאשר הוא יקבל את האזרחות שלו ויש אחרים שאומרים שיכלתי כבר מזמן לקבל את הגרין כארד או לפחות אישור עבודה. השאלה שלי מה נכון?

Citizenship issues

Hi Tal, Once you marry a green card holder you are not entitled to adjust status in the US. That means that you must be here in some other legal status. The reason is that green card holders are subject to the preference system, which means that you have to wait for your priority date to be current until you can get your green card. Once he becomes a citizen you will be eligible to file for adjustment of status and get a work permit and other benefits. You could apply for citizenship only after being married 3 years to a citizen.​

את יכולה לקבל אזרחות על סמך נישואין לאזרח אחרי שהיה לך גרין קארד 3 שנים, (גם אם את נשואה לו כבר 20 שנה).
